This privacy policy applies to the processing of personal data concerning you, carried out through the application accessible on Android and Apple devices (hereinafter the “ Application ”). You can contact us at [email protected] .
The information concerning you is collected and processed by the company Bye Blues, a simplified joint-stock company, registered with the Strasbourg Trade and Companies Register under number 901 843 557, whose registered office is located at 2 Avenue du Neuhof, 67100 Strasbourg (hereinafter “ Bye Blues ”), represented by Mrs. Domitille Boudard.
When collecting and processing your personal data and that of your newborn, Bye Blues, as data controller, ensures compliance with the applicable regulations regarding the protection of personal data, including the Data Protection Act of 6 January 1978 as amended and European Regulation No. 2016/679/EU of 26 April 2016 (GDPR) (hereinafter the “ Applicable Regulations ”).
The purpose of this privacy policy is to inform you of the processing operations carried out on your personal data, and the rights you have.
We encourage you to review this privacy policy regularly to ensure you are aware of any changes to it. You will be notified of any material changes.

DATA COLLECTED BY BYE BLUES
Bye Blues is an app that offers support solutions for parents caring for newborns. The app is connected to the Bye Blues Baby lamp, designed to emit a light specially configured to preserve the natural rhythm of the human body during the night and record the child's sleeping and feeding periods.
In this context, Bye Blues is required to collect and process certain personal data concerning the newborn and the parents.
Please note that all personal data collected by the Baby Blues Baby lamp is anonymized before being transferred to Bye Blues.

Bye Blues may collect your personal data in different ways:

During your exchanges with Bye Blues, of whatever nature, via the contact form on the Site, by email, by post, by telephone or even on social networks;
This personal data may be collected directly by a positive action on your part (e.g. via the Application's drop-down menu, via a contact form, via your subscription to the newsletter) or automatically by our systems, by the deposit of necessary and functional cookies on your terminal.
The collection of personal data required to use the Application and the Bye Blues Baby lamp is done via a drop-down menu. Bye Blues will never ask you to provide your personal information via a free text box to avoid any risk of accidentally collecting personal data that is not strictly necessary for the purpose of the processing.
You can modify your personal data at any time from the Application in the "configuration" tab. You can also modify the data relating to your child's sleeping and feeding periods in the "journal" tab by clicking on the pie chart showing the recorded data. In this case, only the modified and final versions of the data are saved and not the previous versions.

Mandatory information and necessity of collecting personal data
Bye Blues indicates when the provision of information is mandatory by the mention " (mandatory) " (in particular due to a legal, regulatory, contractual obligation or simply in order to be able to process your request or respond to you). If you do not provide this so-called "mandatory" information, Bye Blues may be unable to provide you with certain services, or to follow up on the request or form in question.
Form fields that are not marked as mandatory are left to your discretion. It is up to you to choose whether or not to complete them.

The Bye Blues teams are subject to an obligation of confidentiality, in charge of the processing identified above as part of the performance of their duties (marketing service, after-sales service, support service, etc.), it being specified that all data collected by the Bye Blues Baby lamp is anonymized before transmission to Bye Blues ;

Our external service providers , such as IT service providers managing the host (AWS), the Application developer (CAPCOD) or the after-sales service manager (Bye Blues SAS).

To other third parties if such communication is required by law, regulatory provision or judicial decision or to respond to possible claims or protect the security of your personal data.
Rest assured that Bye Blues ensures that these various service providers provide sufficient guarantees to ensure the security of processing and confidentiality of your personal data. As such, Bye Blues has entered into the corresponding subcontracting agreements with these service providers to define the rights and obligations incumbent on each party and to ensure their compliance with personal data protection regulations.
You also have the option to transmit to trusted third parties, such as healthcare professionals and/or the Caregiver (nanny, family, etc.) , data relating to your child's sleep and diet, collected on the Application. In this context, you acknowledge that this transmission of information is your responsibility and not that of Bye Blues, which is not the originator of this transmission.

TRANSFER OF PERSONAL DATA COLLECTED BY BYE BLUES OUTSIDE THE EUROPEAN UNION
Bye Blues carries out some of these processes using service providers established outside the European Union, in particular due to the storage of cookies on your device.
In the event of data transfer outside the European Union, Bye Blues undertakes to guarantee a sufficient level of protection and to take all appropriate guarantees.
